You are very welcome to the website https://yestalent.com.br (the “Site”) and to our vacancy portal at https://yestalent.com.br/portal-de-vagas/ (the “Vacancies Portal”) and/or by accessing and registering, whether or not attaching your curriculum vitae, in our Talent Bank contained in links originating from the aforementioned electronic addresses, hereinafter referred to as “Websites”. Our Terms of Use set forth legal terms and conditions applicable to your use of our Websites. Please review the terms of use carefully before using our Websites. By accessing, browsing or using the websites (“Use”), all users and visitors (“You”, “You”, “User” or “Users”) declare to accept the terms and conditions contained in these terms of use, as well as our Privacy Policy. If you do not agree with the terms and conditions contained in these terms of use, please do not use the Websites. Yes Talent and its subsidiaries reserve the right to update the terms of use periodically, at its sole discretion. Therefore, we recommend that you review the terms of use periodically for possible updates and modifications.

2. Who is it for

The Websites and all related services are made available only if you can enter into legally valid contracts under applicable law. The Websites are not available to persons under 18 years of age. If you are under 18, please do not use the Websites. By using the websites, you declare that you have full legal capacity, being over 18 (eighteen) years of age.

2) Use any resource, routine or software that disrupts, delays or otherwise harms the operation of the Websites.

3) Defame, insult or act in a way that harms or affects the reputation of Yes Talent or other users.

4) Encouraging conduct considered illegal in both civil and criminal spheres.

Yes Talent, at its discretion, will determine its compliance with the above and will have the right to prevent the use of or delete any material that violates the Terms and Conditions of the websites, without prior notice. Yes Talent will fully cooperate with any authorities or courts requesting disclosure of the identity or location of anyone posting material not in accordance with the above. Even so, users will not have their responsibilities revoked in relation to this Terms of Use, since the content of the website is immediately available to everyone.

The website has links and connections to external websites and the user will be subject to the respective privacy policies and terms and conditions described on these third-party websites. When leaving our Websites via a third-party link, the user understands that Yes Talent is no longer responsible for the content of these third-party websites. Yes Talent has not reviewed or approved these websites and does not control or be responsible for them or their content. Yes Talent does not guarantee that the links to these sites work or are up to date. Yes Talent does not endorse or represent these sites and your use of these links is entirely at your own risk. Any third party can access our website as long as the links are only to the website’s home page and that we are notified in advance by email at privacy@yestalent.com.br. 5. Security and passwords

At this time, it is not yet necessary to create a username and password to register on the Websites or access them. In cases where access via username and password is implemented, each user will be responsible for the security and appropriate use of this password, which must be confidential and never revealed to anyone. Yes Talent does not guarantee that any employer or client will request information about the candidate, will interview or hire the candidate, or that any candidate will be available or meet the requirements of any employer or client.

Yes Talent makes no representation or warranty as to the final terms and duration of any commitment obtained through the Websites.

Yes Talent does not guarantee that any employer or client will keep confidential any information or data it has received. If any of these terms and conditions are invalidated by a court of competent jurisdiction, such termination shall not affect the validity of the remaining provisions, which shall remain in full effect.

The use of the Websites and the downloads contained therein, as well as the operation of these terms of use, shall be governed in accordance with the laws of Brazil. Brazilian courts shall have exclusive jurisdiction over any disputes arising from the use of these Websites.

11. General provisions

You agree that no employment, partnership, representation, agency or joint venture relationship is created between you and Yes Talent as a result of your use of the Websites.

These Terms of Use constitute the entire agreement between you and Yes Talent with respect to your use of the Websites, and are in addition to any agreement between you and Yes Talent. These Terms of Use are governed by the laws of the Federative Republic of Brazil. You may not use or export any Materials or make any copies or adaptations in violation of any applicable laws, regulations or provisions, including, without limitation, the export laws and regulations of Brazil or the United States. In this regard, you agree not to export the Materials to any country or jurisdiction that is included in the list of prohibited or restricted countries under the export laws of Brazil and the United States. Some of the countries currently subject to restrictions under these laws include, but are not limited to: Cuba, Iran, North Korea, Sudan and Syria. The failure or delay by either party in enforcing any term contained in these Terms of Use will not be deemed a waiver of any such term. The aforementioned Clauses will survive the termination of these Terms of Use for any reason or reason.
